These Terms of Service (the “Terms”) govern your use of Contour, an evidence-led facial-fitness application for iPhone, together with any related content, features and services (collectively, the “App”). The App is provided by Contour (“Contour”, “we”, “us” or “our”). By downloading, accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Who can use Contour
You must be at least 13 years old to use the App. If you are under the age of 18 (or the age of majority where you live), you may use the App only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the App you represent that you meet these requirements and that the information you provide is accurate.
2. Not medical advice
Contour is a general fitness and wellness product, not a medical device, and it does not provide medical advice, diagnosis or treatment. The guided sessions, exercises, measurements, scores and educational content are for informational and self-improvement purposes only. They are not a substitute for professional advice from a physician, dentist, orthodontist, physical therapist or other qualified health provider.
Always use common sense and listen to your body. Some exercises load the jaw and neck: stop immediately if you feel pain, soreness, clicking or discomfort, do not exceed the time limits the App suggests (for example, no more than 20 minutes of chewing-based work per day), and consult a professional before starting if you have any jaw, dental, neck or other medical condition, or if you are pregnant. Never disregard professional advice or delay seeking it because of something you read or did in the App. Your use of the App is at your own risk.
3. Results and honest expectations
We describe results as ranges, not guarantees, and we label the strength of the evidence behind each method. Outcomes depend on your consistency, physiology, starting point and many factors outside our control. Timelines shown in the App (for example, “first visible changes in 8–12 weeks”) are typical estimates, not promises. We do not guarantee any specific result, and nothing in the App should be read as such a guarantee.
4. Your photos and content
Contour is designed to keep your data on your device. Your scan photos and metrics are stored on your iPhone. When a scan needs analyzing, the relevant photo is sent over an encrypted connection for that analysis, used once, and is not retained on our servers afterward. We do not sell your photos or use them to train advertising or third-party models. You can delete your photos and data at any time from within the App. Our handling of personal data is described further in our Privacy Policy.
You retain all rights to the photos and content you create. You are responsible for the content you capture and for ensuring you have the right to use it.
5. Subscriptions, billing and renewals
Contour is free to download and start. Certain features require a paid subscription (“Premium”). Subscriptions are sold and billed through your Apple App Store account, and the current options and prices are shown in the App and on the App Store at the time of purchase.
- Payment is charged to your Apple ID account at confirmation of purchase.
- Subscriptions automatically renew at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
- You can manage or cancel your subscription, and turn off auto-renewal, in your Apple App Store account settings after purchase.
- Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.
- Refunds are handled by Apple in accordance with the App Store terms; we do not directly process App Store payments.
6. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your own personal, non-commercial use. All rights not expressly granted are reserved.
7. Acceptable use
You agree not to:
- copy, modify, reverse-engineer, decompile or attempt to extract the source code of the App, except to the extent this restriction is prohibited by law;
- resell, rent, sublicense or otherwise commercialize the App or its content;
- use the App to upload or capture content that infringes the rights of others or that is unlawful; or
- interfere with, disrupt or attempt to gain unauthorized access to the App or its related systems.
8. Intellectual property
The App, including its software, design, text, graphics, the Contour name and logo, and all related content (other than content you create), is owned by Contour or its licensors and is protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
9. Disclaimers
The App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that any content, measurement or score is accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, Contour and its officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising out of or relating to your use of (or inability to use) the App. To the extent liability cannot be excluded, our total liability to you for all claims relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim, or USD 50.
11. Changes to the App and these Terms
We may update, change or discontinue features of the App at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above. Material changes will be communicated where appropriate. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
12. Termination
You may stop using the App and delete it at any time. We may suspend or terminate your access to the App if you breach these Terms or use the App in a way that could cause harm. Provisions that by their nature should survive termination (including intellectual property, disclaimers and limitation of liability) will survive.
13. Apple App Store terms
These Terms are between you and Contour only, not with Apple. Apple is not responsible for the App or its content. To the extent of any conflict between these Terms and the Apple Media Services Terms and Conditions with respect to your use of the App, the Apple terms will govern that conflict. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Any maintenance, support, or product warranty and liability claims are our responsibility to the extent required by law, not Apple’s.
14. Governing law
These Terms are governed by the laws of the jurisdiction in which Contour is established, without regard to conflict-of-laws principles, and subject to any mandatory consumer-protection rights available to you where you live.
